Magistrate SahrKekura of the Pademba Road Magistrate Court No 1 has remanded one Mamusu Dumbuya at the Female Correctional Centre, for allegedly killing one Mohamed Umaru Jalloh at Bottom Mango, Wilberforce, in Freetown.
The accused is before the court on one count charge of manslaughter, which is contrary to law. The particulars of the offence state that, Mamusu Dumbuya, on Friday 26th October 2018, at Bottom Mango, Wilberforce, in Freetown, unlawfully killed Mohamed Umaru Jalloh.
The police witness, Mohamed Juma Jalloh, a businessman and a brother to the deceased, has testified that he recognized the accused and could recall 26th October 2018. He informed the court that, on that fateful day, while he was in town at King Street axis, he received a telephone call from his sister (Zainab) asking him to meet her at Bottom Mango in Wilberforce.
The witness disclosed to the court that, on his way going to Bottom Mango, he received another telephone call from an unknown person, telling him that his brother had dead. He informed the court that he never bothered to go to Bottom Mango. He returned to the Congo Cross Police Station. He detailed the court that, upon his arrival, a team of police officers joined him to go to the Emergency Hospital for identification of the deceased.
He told the court that, when they arrived at the Emergency Hospital, they took the deceased and a postmortem was conducted before his relatives. The witness informed the court that, after the postmortem, the corpse was handed over for burial. He told the court that he later went to the Congo Cross Police Station and made a statement on behalf of the family.
The defense lawyer applied for bail on behalf of her client, noting that her client is a mother of school going children, adding that she is also a bread winner of a family. The defense lawyer told the court that the accused will not pose any flight risk and she has reliable sureties, who are willing and ready to enter into her cognizance.
The defense lawyer also noted that, her client will always make herself available as and when she is needed. She added that the accused is presumed innocent until she is proven guilty. She made her application pursuant to section 79 (2) of the Criminal Procedure Act of 1965.
The Police Prosecutor, Assistant Superintendent of Police ASP Daboh, objected to bail due to the seriousness of the offence and the inconsistent address of the accused. He said if granted bail, she will interfere with the prosecution witness or witnesses.
Magistrate SahrKekura refused bail on the grounds that, having heard application for bail and also having heard the objection from the prosecution, he saw no reason to give bail to the accused.
The matter was adjourned to the 12th December, 2018.
