For Abuse of Process… Accused Burglar Discharged

Magistrate Alhaji Suliaman Koroma the Presiding Magistrate at the Ross Road Magistrate Court No.1 has yesterday discharged one Issa Kaigo who was charged with the offences of burglary and larceny and malicious damage, contrary to law.
Magistrate Koroma before discharging the accused Issa Kaigo stated that a similar matter was earlier mentioned before him but it was adjourned adding that the accused has two files before with similar offences and complainant. He told the Police Prosecutor, ASP Bangura that it is abuse of process and therefore discharged the accused accordingly.
Defense Counsel, Tejan Conteh representing the accused, Issa Kaigo, told the court that his client has been incarcerated for three weeks and that his client liberty is at stake.
Police Prosecutor, Assistant Superintendent of Police, Osman Mohamed Bangura offered no evidence against the accused on the same file.
The police charges states that Issa Kaigo, on Monday, 24th February, 2020 at Grafton, in the Freetown Judicial District in the Western Area of the Republic of Sierra Leone, broke and entered into the dwelling house of the complainant ,Betty Bongah, with intent to steal therein certain properties valued at one million two hundred and fifty thousand Leones (Le 1,250,000) properties of the complainant, Betty Bongah.
The police charge sheet furthered that Issa Kaigo on the same date and address, maliciously damaged the gate of the complainant Betty Bongah valued at sixty thousand Leones (Le 60,000).
