Mohamed Gassama and eight others are standing trial before Magistrate Hadiru Daboh, at the Ross Road Magistrate Court No. 3, for allegedly encroaching on a property of Madam Alice Kenney, who doubles as the applicant, situated at No. 7I Black Hall Road in Freetown.
Madam Kanney told the court that she recognized the defendants who have been occupants of the property for seven years unknowing to her. She told the court that the defendants took possession of her property while she was residing in the United State of America.
The witness recounted that, upon her return to Sierra Leone, she served all the defendants notices to vacate the premises. But they all failed to do so. The said notices are dated the 11th January, 2021. They were produced and tendered to form part of the court`s records.
To ascertain the facts of her claim to the property, she tendered a conveyance dated 29th January, 1986 for identification and was marked as exhibit Z.
Eventually, the applicant pleaded with the bench to evict all the defendants from the premises within the shortest possible time.
