Magistrate Discharges Accused

Magistrate Alhaji Suliaman Koroma at the Ross Road Magistrate Court No. 1 has discharged one Mohamed Gbessay Sesay who was charged with the offence of threatening language against the complainant.
According to the presiding Magistrate, the matter has appeared before the court twice, adding that since the inception of the matter, only the complainant has testified since then he has not been coming to court.
He said the accused has always been in court on any adjourned date.
Defense Counsel, Lawyer Edward, made an application on behalf his client citing section 94 of the Criminal Procedure Act No. 32 of 1965.
He furthered his application stating that on the first appearance of the matter, the complainant himself was not present, noting that it is a clear indication that the complainant was no longer interested in the said matter and therefore he should be discharged.
Police prosecution witness, Assistant Superintendent of Police, O.M Bangura made an application for the court to give him one more adjourned date and that he vowed that he would make the second witness available in court for speedy trial of the matter.
But his application was not granted but rather to discharge the accused (Mohamed Gbessay Sesay) accordingly.
